Agreement to Terms

By downloading or using DadGains ("the App"), you agree to these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms are between you and The Yard Apps ("we," "us," or "our").

DadGains is not a medical application and does not provide medical advice.

All content in the App — including exercise descriptions, workout suggestions, tracking features, and any other information — is provided for general informational and fitness tracking purposes only. Nothing in the App constitutes or should be construed as:

Medical advice, diagnosis, or treatment
A recommendation for any specific exercise, program, or physical activity
A substitute for professional medical advice, diagnosis, or treatment

Always consult a qualified physician or other licensed healthcare provider before beginning any new exercise program, particularly if you have or suspect you may have a medical condition, injury, or other health concern. Never disregard or delay seeking professional medical advice because of something you read or tracked in this App.

AI-Generated Content

DadGains includes AI-powered features — AI Coach chat, AI Workout Generator, Program Builder, and Weekly Check-in — that produce responses using a large language model hosted by a third-party provider (Groq). Any content generated by these features is machine-generated, informational only, and not guaranteed to be accurate, safe, or appropriate for your specific situation.

You acknowledge that AI-generated workouts, coaching responses, and recommendations:

Are not medical, physical therapy, or professional fitness advice
May contain errors, outdated information, or recommendations that are not suited to your body, injuries, or experience level
Should be evaluated by you (or a qualified professional) before acting on them

The use of AI features also involves the transmission of limited training data to Groq. This is described in detail in our Privacy Policy at https://dadgains.app/privacy. You may use DadGains entirely without AI features if you prefer not to share any data with third parties.

Exercise at Your Own Risk

Physical exercise involves inherent risks, including the risk of injury or death. By using DadGains to log, plan, or guide your physical activity, you acknowledge and accept that you exercise entirely at your own risk.

You agree that The Yard Apps is not responsible or liable for:

Any injury, illness, or adverse health outcome resulting from your use of the App or any physical activity you undertake
The accuracy or appropriateness of any exercise information included in the App for your specific circumstances
Any decision you make regarding your fitness or health based on use of the App

You are solely responsible for assessing your own physical condition and the risks involved in any exercise you perform.

Use of the App

DadGains is licensed to you for personal, non-commercial use. You agree not to:

Reverse engineer, decompile, or disassemble the App
Use the App for any unlawful purpose
Attempt to extract or reuse any portion of the App's code or assets without permission

No Accounts or Subscriptions

DadGains currently does not offer user accounts, subscriptions, or in-app purchases. The App is provided as a single download. We reserve the right to introduce optional features, subscriptions, or purchases in future versions; any such changes will be clearly disclosed and will require your affirmative action to participate.

Intellectual Property

All content, design, code, graphics, and other materials in DadGains are the property of The Yard Apps and are protected by applicable intellectual property laws. These Terms do not grant you any rights to our intellectual property beyond the limited license to use the App as described herein.

Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be error-free, uninterrupted, or free of bugs or viruses.

Limitation of Liability

To the fullest extent permitted by applicable law, The Yard Apps and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of or inability to use the App, even if we have been advised of the possibility of such damages.

Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid for the App (if any).

Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Changes to These Terms

We may update these Terms from time to time. When we do, we will update the effective date at the top of this document. Your continued use of the App after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
